Can You Negotiate Real Estate Commission in Colorado?

Yes, you can negotiate real estate commission in Colorado. There is no law that sets a fixed commission rate, and there never has been. Every commission you pay is the result of an agreement between you and the agent you hire. If that number feels high, you are allowed to push back.

That said, most consumers do not negotiate. They accept the first number an agent quotes because they assume the rate is standard or because they do not feel comfortable pushing back on someone they are about to trust with a major transaction. Understanding how commission actually works makes negotiating a lot easier.

What Is the Standard Commission in Colorado?

There is no official standard. Historically, total commissions in the Denver metro ranged from 5% to 6% of the sale price, split between the listing agent and the buyer's agent. After the NAR settlement in 2024, commission structures changed significantly. Buyer's agent compensation is now negotiated separately rather than automatically offered through the MLS.

In practice, many listing agents in Colorado still quote 2.5% to 3% for their side of the transaction. That is the number worth negotiating.

How to Negotiate Commission With a Listing Agent

The simplest approach is to ask directly. Before signing a listing agreement, ask the agent what their commission rate is and whether it is negotiable. Most agents will not proactively offer a discount, but many will accept a lower rate rather than lose the listing entirely.

A few things that strengthen your negotiating position:

  • Your home is priced well and likely to sell quickly. Agents value clean, easy listings.

  • You are a repeat client or a referral from someone they know.

  • You are also planning to buy your next home and can offer that business to the same agent.

  • You have already interviewed agents and received competing proposals.

What About Buyer's Agent Commission?

Since the NAR settlement, sellers are no longer required to offer buyer's agent compensation through the MLS. You can choose whether to offer it, how much to offer, and how to structure it. Some sellers offer a flat dollar amount rather than a percentage. Others offer nothing and leave it to buyers to negotiate compensation with their own agents.

In a balanced or buyer-friendly market, offering reasonable buyer's agent compensation can attract more offers. In a strong seller's market, you may have more flexibility to reduce or eliminate it. Your listing agent should advise you on what makes strategic sense for your specific home and market conditions.

The Easiest Way to Negotiate: Choose an Agent Who Already Charges Less

The most reliable way to reduce what you pay is to hire a listing agent who charges a lower rate upfront rather than trying to negotiate down a high-commission agent after the fact. The result is the same — you pay less — but you start the relationship on solid ground without any awkwardness.
