How Are Real Estate Agent Commissions Negotiated Now in 2026?

Real estate commission negotiations changed significantly after the NAR settlement took effect in August 2024. If you are buying or selling a home in 2026, understanding how these conversations work now can save you real money and help you avoid surprises at the closing table.

How Listing Agent Commission Is Negotiated

When you hire an agent to list and sell your home, you sign a listing agreement that includes the agent's commission rate. That rate is agreed upon before the home hits the market and is paid at closing out of the sale proceeds.

There is no required rate. Agents set their own fees, and those fees are negotiable. In Colorado, traditional listing agent fees typically range from 2.5% to 3%, but some agents charge less and some charge more. You are not obligated to accept the first number quoted to you.

The most effective negotiation strategy is to interview multiple agents and compare rates alongside the services they offer. An agent who charges 1% and provides full service marketing, professional photography, and active negotiation is a better deal than one charging 3% who offers the same.

How Buyer's Agent Commission Is Negotiated Now

This is where things changed most dramatically. Before the NAR settlement, buyer's agent compensation was offered by sellers through the MLS and the conversation never really happened. It was automatic.

Now there are two separate conversations happening:

  • Between the buyer and their agent, through the buyer representation agreement. This document spells out what the buyer's agent expects to earn.

  • Between the seller and the buyer's agent, negotiated through the purchase contract. Sellers can offer compensation, negotiate it, or offer nothing.

In practice, many sellers in Colorado still offer buyer's agent compensation to attract more buyers. But the amount is no longer automatic, and both sides now have more room to push.

Can Buyers Negotiate Their Agent's Fee?

Yes, and they should. The buyer representation agreement is a contract, and the compensation terms in it are negotiable before you sign. Asking for a lower rate, a flat fee arrangement, or a shorter term is entirely reasonable. Most buyers do not ask because they do not realize they can.
